دراسة مقارنة في القانونين الاردني والعراقي
Abstract
Private universities seen to have a dominate role in the expansion of education and knowledge. And also in preparing a well trained and educated generation, in accordance with the informatics and scientific developments. The deficiency of the governmental financial resources in many countries in financing the expedient expansion of higher education, has lead to the situation of trying to find an alternative financing resources. The most prominent of these resource was the attempt to give the private sector a distinguished role which leads to increase the number of private universities. The establishment and flourish of the private academic education, make it necessary for the legislator to intervene in putting legal basis which guarantee organizing this kind of education and its development through laing down certain legal measures to secure the equality of the academic education and high level of performance for the private universities. This research also deals with examining the legal aspects of the private colleges and universities. Also it sheds the light on the legal frame of both Jordanian and Iraqi law, including its definition, its legal nature, its establishment, financing and finally the state's control on it.
